Terms of Service

These Terms of Service ("Terms") govern your use of nicobrooks.io and any purchases made through it, operated by nicobrooks.io ("we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms.

We sell physical goods as described on the Site, hand-assembled in small batches. We make reasonable efforts to display accurate product descriptions, images, and pricing, but we do not warrant that descriptions, colors, or other content are error-free. We reserve the right to correct pricing or listing errors and to limit quantities.

Unless a listing is explicitly marked as a finished or production release, all devices sold are pre-production test or development units. This means:

• The product may still be under active development, and its design, firmware, and functionality may change without notice in future units.
• Devices may have limited functionality, rough edges, or bugs, and are not guaranteed to be fit for any particular purpose beyond evaluation and testing.
• Devices are not certified to consumer product safety, EMC, or wireless standards, including FCC or CE, unless explicitly stated.
• You are purchasing the unit as-is, for personal testing, evaluation, or hobbyist use, at your own risk.
• Support, firmware updates, and spare parts for development units are provided on a best-effort basis only and are not guaranteed.

By purchasing, you acknowledge and accept the experimental nature of the product.

All payments are processed through a third-party payment processor. We do not store your full payment card details on our servers. By placing an order, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or inventory issues. If we cancel an order after payment, you will receive a full refund for that order.

Estimated shipping times are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. We are not responsible for delays caused by the carrier once the item has shipped.

All content on the Site, including designs, logos, product photography, and text, is owned by nicobrooks.io or its licensors and may not be reproduced, distributed, or used commercially without written permission.

Development and test units are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are not permitted by law.

To the fullest extent permitted by law, nicobrooks.io is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it, including damages resulting from device malfunction, data loss, or use of experimental hardware or firmware. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, unless otherwise required by your local consumer protection laws.
